Our office’s Songdo Young, Attorney, presented at an event hosted by the Seoul Bar Association on December 17, 2016, and delivered a lecture on the topic of ‘Digital Evidence Law and IT Knowledge from a Lawyer's Perspective’ to approximately 100 attorneys.
Starting with examining the forensic perspective on the basis for considering the tablet PC, which was the biggest issue recently, as belonging to Choi Soon-sil, the lecture covered the importance of digital evidence and forensics in various areas of attorneys' work, not only the area of ‘criminal defense’ but also ‘criminal charges,’ ‘legal/accounting consulting,’ and ‘civil lawsuit representation,’ as well as the evidentiary ability of digital evidence according to revised Article 313, Paragraph 2 of the Criminal Procedure Act.
Because most work is now done through computers, laptops, mobile phones, and tablet PCs, we shared practical know-how on how to find various traces remaining on these digital devices to secure favorable evidence. We explained the special need for expertise in evidence acquisition, which is constantly increasing not only in civil/criminal lawsuits but also in corporate audits, internal misconduct verification and disciplinary actions, making it difficult to proceed without the assistance of experts.

And (1) investigative agencies such as the prosecutors' office and police, and (2) government ministries such as the Fair Trade Commission and the National Tax Service, and (3) the Board of Audit and Inspection, discussed countermeasures from the perspective of ‘right to participate’ and ‘relevance’ in the process of seizure/search and on-site investigation of digital evidence (storage media).
